Previously, lawyers practising in immigration law needed to also be registered as migration agents with the Office of the Migration Agents Regulation Authority. This is no longer the case. Section 280 of the Migration Act 1958 (Cth) (Migration Act) lists a number of occupations and roles that act as exceptions to the general rule that only registered migration agents may give immigration assistance. Section 280(3) permits an Australian legal practitioner to provide such assistance in association with legal practice.
